The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 325, 307, 504 and 506 of the Indian Penal Code. Allegation against the petitioner no. 1 Sunil Thakur is to have caused injury with farsa at the head of Chandrika Thakur. The case diary would reveal that there is no injury report of Chandrika Thakur. Rather injury report of Shambhu
Patna High Court Cr.Misc. No.51974 of 2016 (3) dt.10-02-2017 2/2 Thakur and Pramod Thakur is there. Allegation of commission of injury to Pramod Thakur is against co-accused Binod Thakur. There is general and omnibus allegation against other petitioners. There is case and counter case.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari/Successor Court in connection with Pipra Police Station Case No. 52 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
