In this case, the petitioner is seeking anticipatory bail in connection with Jehanabad P.S. case No.136 of 2016, registered for the offence punishable under Section 420 of the Indian Penal Code and 4/10 of the Bihar Conduct of Examination Act, 1981, pending in the court of C.J.M., Jehanabad.
Allegation has been made that the petitioner sent another person to appear in matriculation examination on his place and the person impersonated him was caught at the examination centre.
Looking to the fact that the petitioner is a student, for the present this Court is not inclined to grant anticipatory bail to the petitioner. However, if the petitioner surrenders before the court
Patna High Court Cr.Misc. No.6043 of 2018(2) dt.02-02-2018 2/2 below within three weeks from today and pray for regular bail, the court below will consider the age of the petitioner and also considering that he is a student, will dispose of the case on the same day of his surrender.
With the aforesaid observation and direction, the application is disposed of.
