The petitioner apprehends his arrest in connection with Bela P.S. Case No. 123 of 2018 registered under Sections 341, 323, 504, 506/376 of the Indian Penal Code and section 4 of the POCSO Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that on perusal of order of the learned Sessions Judge, it transpired that the victim was examined by the Medical Board in which the Doctors have found her age about 18-19 years and no sign of rape was found. Further submission is that petitioner has no criminal antecedent.

No.25017 of 2019(2) dt.18-04-2019 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (POCSO Act), Sitamarhi in connection with Bela P.S. Case No. 123 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
