The petitioner apprehends his arrest in a case registered for the offence under Section 304 / 34 of the Indian Penal Code.

As per the prosecution case, the allegation against this petitioner is that he killed the grandson of informant by giving electric shock.

It is submitted on behalf of petitioner that though, the alleged occurrence is said to have taken place on 13.09.2020, but the F.I.R. has been lodged on 19.09.2020 without there being any plausible explanation of delay. It is further submitted that during course of investigation, the chowkidar has stated that no one has killed the grand son of informant. Petitioner has got clean antecedent.

No.35896 of 2021(3) dt.27-06-2022 2/2 However, learned counsel for the informant vehemently opposes the prayer for anticipatory bail of petitioner and submits that there is specific allegation against this petitioner of giving electric shock to grandson of informant and this fact has been supported by several witnesses during investigation.

Considering the serious nature of accusation and materials available on record, the prayer for anticipatory bail of petitioner is rejected.
