JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-10-2017 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 323, 324, 307, 504/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has falsely been implicated in the present due to dirty village politics. The informant and the petitioner are next door neighbour. It is further submitted that similarly situated co-accused, namely, Ranjan Mahton @ Mantu and Saurav Kumar have already been granted anticipatory bail vide order dated 26.07.2017 passed in Cr. Misc. No. 34603 of 2017 (Annexure 3).

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.41598 of 2017 (3) dt.16-10-2017 2/2 the case, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Munger, in Muffasil P.S.Case No. 109 of 2017,subject to the conditions as laid down u/s 438(2) Cr.P.C.
