Petitioners apprehend arrest in connection with Complaint Case No. 2643 of 2018 registered for the offence punishable under sections 420, 467, 468, 471/34, 120B of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case merely on suspicion. Parties are agnates and co-sharers.
Patna High Court CR. MISC. No.25061 of 2019(4) dt.01-05-2019 2/2 The instant case is out and out a civil dispute for which a title suit bearing T.S. No. 397 of 2007 is going in the Civil Court. No criminal offence is made out against these petitioner. Expect petitioner no. 3, who is accused in one another case in which he is on bail, all other petitioners have clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Complaint Case No. 2643 of 2018, Tr. No. 1909 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
