JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 325, 307, 379 and 504/34 of the Indian Penal Code. The prosecution case is that the petitioner made assault with the back of spade on the head of the informant and when the wife and son of the informant came to rescue, they were also assaulted when other accused persons snatched the watch and earring of the son and wife of the informant. It is submitted by learned counsel for the petitioner that the injuries of the informant's sides have been found to be simple superficial in nature. The manner of assault suggests that the petitioner has no intention to kill the informant. There is counter version of the occurrence also and petitioner's side also received

Patna High Court Cr.Misc. No.56952 of 2015 (2) dt.17-12-2015 2/2 injury. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jhanjharpur in connection with Phulparas P.S. Case No. 219 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
