The petitioners are apprehending arrest in a case registered for the offences punishable under sections 272/273 of the Indian Penal Code and 47a of the Excise Act. It is alleged that 80 litres of country made liquor were recovered from a lonely place of orchard, alleged to be kept by the petitioners. Though, the petitioners succeeded to escape from the place of seizure.

It is submitted by learned counsel for the petitioners that petitioners are in no way connected with the place of seizure. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.54916 of 2015 (2) dt.04-12-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Muffasil P.S. Case No.349 of 2015, pending before the learned CJM, Gaya.

With the above observation, this application is, accordingly, disposed off.
