The petitioner apprehends his arrest in connection with Khajekala P. S. Case No. 123 of 2016 registered for the offences punishable under Sections 406, 379, 341, 323, 504 of the Indian Penal Code.
Allegedly, the petitioner has taken Rs. 1,30,000/- from the informant as loan with an assurance to return the same within three months but when he did not return on one plea or the other then, on 07.06.2013 when the informant went to demand money he was abused and assaulted with fat and danda and further amount of Rs. 2,000/- was snatched.
Submission is of false implication and that this case has

No.49282 of 2017(2) dt.17-10-2017 2/2 been lodged on 07.06.2016 after three years from the last date of the occurrence i.e. 07.06.2013 and no explanation has been given for lodging the case after such a delay. The petitioner has given three vehicles to the informant and as such the petitioner deserves sympathetic consideration.
Learned APP opposes the prayer of pre-arrest bail but fairly submits that the case has been lodged after three years. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Khajekala P. S. Case No. 123 of 2016, ubject to the condition as laid down under Section 438 (2) of the Cr.P.C.
