The petitioner is apprehending his arrest in connection with Siwan Town (Sarai) P.S.Casae no.550/18 , registered for offences punishable under Sections 406, 420, 120(B), 506, 504/34 of the Indian Penal Code and Section 138 of the N.I. Act.

Allegation against the petitioner and other accused persons is that in conspiracy, they misappropriated Rs.23,52,900/- of the complainant and his mother and on demanding the money back, they are threatening the complainant and his family members.

Submission of the learned counsel for the petitioner is that whatever the allegation is there that is against Shabaj

Patna High Court CR. MISC. No.26969 of 2019(2) dt.25-04-2019 2/2 Khan and the petitioner has been made accused only because he is maternal uncle of Shabaj Khan.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan, District Siwan in connection with Siwan Town (Sarai) P.S.Case No.550 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to cooperate in the investigation, otherwise his bail bond shall be cancelled..

With the aforesaid direction, this application is allowed.
