JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 This is an application for grant of anticipatory bail in connection with Sadar P.S. Case No.401 of 2016, disclosing offences under Sections 414. 420, 120B and 34 of IPC. Prosecution story disclosed that a motorcycle was recovered from the house of the petitioner and in the confessional statement of the co-accused, the name of the petitioner has transpired.

Submission of the learned counsel for the petitioner is that the recovery was not made from the house of the petitioner, rather behind the house of the petitioner and the co-accused has disclosed the name of the petitioner.

Having heard both sides, in view of the allegation and recovery of motorcycle from the house of the petitioner, I am

No.26828 of 2019(2) dt.09-07-2019 2/2 not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit.
