The petitioner seeks regular bail in connection with Katra P.S. Case No. 62 of 2021 for the offence registered under Sections 30(a), 32/41(1) of the Bihar Prohibition and Excise Act.

The allegation is regarding recovery of 3392.640 litres of illicit liquor from the water tank situated in the house of co-accused person namely Avinash Mandal. During the course of investigation it has transpired that the illicit liquor has been kept by one Sawan Thakur and thereafter, the name of the petitioner and other co-accused person had transpired in the

The learned senior counsel for the petitioner Shri N.K. Agrawal has submitted that the petitioner is innocent, has been falsely implicated in the present case, is having a clean antecedent and he is languishing in custody since 25.03.2021. Learned senior counsel for the petitioner has further submitted that the place from where illicit liquor has been recovered admittedly belongs to one Avinash Mandal, hence the petitioner is having no concern either with the seized illicit liquor or the place from where the same has been recovered. Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned senior counsel for the petitioner and taking into account the materials available on record as also considering the fact that the petitioner is having no concern either with the seized illicit liquor or the place from where the same has been recovered and he is languishing in custody since 25.03.2021, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

No.36374 of 2021(2) dt.14-12-2021 3/3 Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Katra P.S.
