The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273, 414, 120B and 34 of the Indian Penal Code and sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, from the poultry farm as also the pick-up van of the petitioner 642.96 litres of liquor was recovered.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner and he has been falsely implicated in the case. He is in custody since 15.3.2021 and has no criminal antecedent.

No.37476 of 2021(5) dt.21-03-2022 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Meenapur P.S. Case no. 229 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
