====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-02-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Saharsa Sadar P.S. Case No. 259 of 2010, registered for the offences punishable under Sections 406, 420, 409 and 120B of the Indian Penal Code.

Learned counsel for the petitioner by drawing my attention towards Annexure-2 has submitted that the entire money was refunded to the complainant and in this respect she has filed an affidavit. The xerox copy of that affidavit is

Patna High Court CR. MISC. No.36373 of 2021(2) dt.03-02-2022 2/2 annexed with record as Annexure-2 and in Paragraph-6, the complainant has stated that she has received the entire amount and in Paragraph-9, thereof, she has mentioned that she has no any complain against the present petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No. 259 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
