The petitioners apprehend their arrest in connection with Khagaria (Chitragupta Nagar) P. S. Case No. 344 of 2017 instituted under Sections 147, 148, 149, 353, 183 and 427 of the Indian Penal Code.
The allegation, in brief, is that the Circle Officer and police personnel reached to pacify the disputes between two groups at the spot when the petitioners along with 100 unknown persons uprooted the plants in the field and also intended to assault
Patna High Court Cr.Misc. No.37574 of 2017 (2) dt.10-08-2017 2/2 and out of that crowd, one person threw stone over the police personnel.
Learned counsel for the petitioners submits that there is dispute of way in the two groups and no specific allegation is levelled against the petitioners and the allegation of pelting a stone is against one unknown person and these petitioners have no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioners, namely, (1) Ram Bilash Paswan, (2) Brahmdeo Paswan, (3) Pandav Paswan, (4) Rajesh Paswan and (5) Sharma Paswan, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chtragupta Nagar) P.S.Case No. 344 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
