Heard the parties in virtual Court.
Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 of the IPC and 30(a) of Bihar Prohibition and Excise Act.
This application for regular bail has been taken up for out of turn hearing as the petitioner submitted in the mentioning slip that his father died on 15.09.2021 and the petitioner is to perform his last rites.
Allegation is that the petitioner was not there at the time of recovery of liquor rather the co-accused who were there disclosed name of the petitioner. Petitioner is in custody since 24.03.2021. Investigation of the case is already complete.
Patna High Court CR. MISC. No.36352 of 2021(2) dt.21-09-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with K.Hat (Maranga)Police Station Case No.156 of 2021 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
At the time of furnishing bail bond, the petitioner shall file affidavit before the learned court below that his father, in fact died, as claimed.
