The petitioner has been in custody since 06.12.2018 in connection with N.D.P.S. Case No. 12/18 arising out of Ara Town P.S. Case No. 738/2018 registered for the offence punishable under Sections 21(B) of N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner was arrested along with one Rajesh Chaudhary, near the Gangi Pul and on search, it is alleged, that from the pocket of the co-accused Rajesh Chaudhary, 6 grams of Heroin are said to have been recovered. Learned counsel for the petitioner further submits that it is evident that so far as the present petitioner is concerned, no such recoveries were made from him and, therefore, since the petitioner is having a clean antecedent,
Patna High Court CR. MISC. No.25316 of 2019(2) dt.19-04-2019 2/2 his prosecution in connection with the present case is wholly irregular and he may be extended the privilege of regular bail. It is further submitted that since the petitioner has a clean antecedent, he is willing to abide by the terms and conditions of this Court.
Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhojpur, Ara, in connection with N.D.P.S. Case No. 12/18 arising out of Ara Town P.S. Case No. 738/2018.
