JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 28-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Nabinagar Police Station Case No. 174 of 2013, disclosing offences under Sections 147, 148, 149, 427, 353, 124A, 302 of the Indian Penal Code, Section 17 of the C. L. A. Act, Sections 3/4/5 of the Explosive substances Act and Section 16, 17, 18, 19, 20, 38 of the U. A. P. A. Act.
Considering the gravity of the offences and incriminating materials on record, I am not inclined to grant the petitioner privilege of anticipatory bail, in the light of the Supreme Court's decision, in the case of Jai Prakash Singh v. State of Bihar and Another, reported in
Patna High Court Cr.Misc. No.41098 of 2016 (2) dt.28-09-2016 2/2 (2012) 4 SCC 379,.
This application for anticipatory bail, is hereby, rejected.
The petitioner, Dharmendra Singh, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
