JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-10-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Chapra (Mufassil) P.S. Case No. 204 of 2020 for the offence under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 36, 37, 38 and 41(i) of the Bihar Prohibition and Excise Act, 2016.

In the instant case total 50 litres of country made liquor and 650 litres of mixture of Gur and Mahua i.e. raw material for manufacturing country made liquor was seized. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that nothing was seized from the conscious possession of the petitioner.

Considering the aforesaid, the Court is not inclined to

Patna High Court CR. MISC. No.22933 of 2020(2) dt.01-10-2020 2/2 grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail is rejected. However, he may surrender before the court below within one month from today and prays for regular bail, which shall be considered and disposed of on the same day without being prejudiced by the order of this Court considering the submission that nothing was recovered from the possession of the petitioner.
