This application for regular bail arises out of Baikunthpur P.S. Case No. 97 of 2019, disclosing offence punishable under Sections 304-B/201/120-B/365/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The petitioner is in custody sine 14.05.2019. He is the husband of the deceased. His prayer for bail was earlier rejected by this Court by an order dated 17.03.2020, passed in Cr. Misc. No. 78212 of 2019, considering the materials collected during the course of investigation. Learned counsel for the petitioner has submitted that there is no tangible evidence to support the prosecution's case of

According to him, no useful purpose will be served if the petitioner is permitted to remain in custody any more, since he is ready to abide by the terms and conditions which may be imposed for his release on bail. Considering the facts and circumstances, particularly the fact that the petitioner has remained in custody since 14.05.2019, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Judicial Magistrate 1st Class, Gopalganj, in Baikunthpur P.S. Case No. 97 of 2019.
