JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioners apprehend their arrest in connection with Ballia P.S.Case No. 158 of 2017 registered for the offences under Sections 147, 148, 149, 447, 323, 325, 307, 427 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioners is of assault. Submission of learned counsel for the petitioners is that land dispute between the parties and there is case and counter case and all the injuries are simple in nature.
Heard learned APP also.
In the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five

No.3993 of 2018 (2) dt.01-02-2018 2/2 thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No. 158 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
