JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Kako P. S. Case No.195 of 2017 registered under Sections 341, 323, 504, 506, 379 and 307/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the specific allegation of assault with lathi upon the head of the informant is against co-accused Anesh Manjhi. It is further contended that the allegation against the petitioner that he took away Rs.5000/- from the possession of the informant is absolutely false. He submitted that the petitioner is co-villager and his name has been given only because there was

Regard being had to the nature of allegation, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-4-cum-Additional Chief Judicial Magistrate, Jehanabad in Kako P. S. Case No.195 of 2017, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
