JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 452,341 and 354 of the Indian Penal Code.

The accusation is of entering into the house at night and outraging the modesty of the informant.

It is submitted by the learned counsel for the petitioner that for the occurrence of 11.8.2014 at 11 P.M. the FIR was registered on 13.8.2014 at 3.30 P.M. The petitioner is next door neighbour of the informant and in the background of dispute with regard to drainage the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.54757 of 2015 (2) dt.04-12-2015 2/2 Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Katihar, in connection with Abadpur P.S. Case No.93 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
