JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner prays for grant of anticipatory bail in Dehri P.S.Case No.300 of 2010 registered under Section 392 of the Indian Penal Code.

The case was lodged in 2016 under Section 392 of the I.P.C. On the basis of the statement of co-accused name of the petitioner transpired. He continued to evade his arrest although the police requested the court below for issuance of non-bailable warrant and processes etc. Ultimately, he surrendered and prayed for grant of anticipatory bail which was considered and rejected by the learned Sessions Judge in the year 2013.

Patna High Court Cr.Misc. No.48772 of 2016 (2) dt.16-12-2016 2/2 Now prayer for anticipatory bail has been made. Looking to the facts and circumstances of the case and the materials reflected from the record, in my view, it is not a fit case for grant of anticipatory bail.

Prayer for grant of anticipatory bail of the petitioner is rejected.
