Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 323, 447, 307, 506, registered in connection with Kutumba P.S. Case No.168 of 2020. As per allegation, the accused persons named in the FIR including the petitioners along with nine accused persons, assaulted the informant and his son Ranjeet Kumar. His son was referred to PMCH.

Learned counsel for the petitioners has submitted that there was case and counter case and the members of petitioner's side

Patna High Court CR. MISC. No.36372 of 2021(4) dt.24-03-2022 2/2 have also sustained more serious injuries than the present informant and his son.

The case diary along with injury report was called for. The nature of injury in respect of Ranjeet Kumar was not available as he was referred to PMCH. So far as the injury sustained by informant Awadh Bihari is concerned, it is simple in nature. Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioners, let the petitioners above named, in the event of their arrest or surrender within three weeks from the date of communication of this order be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad, in connection with Kutumba P.S. Case No.168 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Office shall ensure that all the defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) Prakash Narayan /- U T
