1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 506 and 34 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a young boy aged about 25 years and has antecedent of one case. It is next submitted that petitioner has appeared in the final examination of his Law from Chanakya Law University this year. It is next submitted that informant was not a Student of Chanakya Law University and when farewell was being given to the 5th Year Student, in which informant as an outsider had participated, on which the petitioner and others stands
Patna High Court CR. MISC. No.29584 of 2024(2) dt.17-05-2024 2/2 objected to his participating in the farewell when the occurrence is alleged to have taken place. It is next submitted that petitioner is a law student, in the event, if he is sent to judicial custody, his entire career would be jeopardized and chances are bright that he might come in contact with hardened criminal.
4. Learned A.P.P. opposes the anticipatory bail application.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Ms. Vibha Rani, the learned A.C.J.M.-VIII, Patna in connection with Jakkanpur P. S. Case No.188 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
