The petitioner apprehends his arrest in connection with Pachrukhi Sarai O.P. P.S. Case No. 150 of 2016, registered under Sections 341, 323, 324, 307 and 337/34 of the Indian Penal Code. The accusation is that the petitioner started to construct the house without measurement of the land, on which, the informant made protest then petitioner caused injury at the head of the informant through sword. When Rafique and Nasruddin, brother and uncle of the informant, rushed to save him then they were also assaulted by Atiul Rahman and Mujibul Rahman, both sons of petitioner, through stick and bamboo.
Patna High Court Cr.Misc. No.16318 of 2017 (4) dt.03-08-2017 Learned counsel for the petitioner submits that occurrence took place due to land dispute. Moreover, four injuries were found on the person of the informant, which is said to be caused by the petitioner, is of simple in nature. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Siwan, in connection with Pachrukhi Sarai O.P. P.S. Case No. 150 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
