JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 376 of the Indian Penal Code and 4 of POSCO Act. Allegation is that the petitioner committed rape upon the victim.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. On the promise of marriage the petitioner is alleged to have established physical relationship with the victim. Later on the petitioner refused to get married with the victim. Hence the present case has been instituted.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st-cum-Special Judge, Madhubani in connection with Khutauna P.S. case No.4 of 2019 corresponding to G.R. No.6 of 2019.
