JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-09-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Madhuban P.S. Case No. 290 of 2016 registered for the offence punishable under sections 341, 323, 504, 304B, 201 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that initially no first information report was lodged. Later on after about one and half months of the alleged date of occurrence, the present complaint case has been lodged, that too without any explanation. There is no post mortem report on the record. As a matter of fact, after knowing about the real facts, the informant has compromised the matter. Petitioners have no criminal antecedent.

No.35969 of 2017(3) dt.12-09-2017 2/2 Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, East Champaran at Motihari in connection with Madhuban P.S. Case No. 290 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
