The petitioner apprehends her arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is a lady having clean antecedent and allegation is of recovery of five litres of liquor from the house of the petitioner, ten litres of liquor from the house of Pokhraj Chaudhary and 8 litres of liquor from the house of accused Sudarshan Chaudhary. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and the house does not belong to her, it is further submitted that petitioner was not apprehended from the spot as such nothing
Patna High Court CR. MISC. No.27686 of 2022(2) dt.28-06-2022 2/2 was recovered from her conscious possession and her name was disclosed by the villager with whom she was on an inimical term.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner and in the nature of allegation and recovery, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Magadh University P.S. Case No. 197 of 2021 subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
