JUSTICE NANI TAGIA ORAL ORDER 02-07-2025 This contempt application has been filed alleging violation of the order dated 21.12.2018 passed in CWJC No. 14016 of 2015 whereby the respondent No. 3 therein / the Engineer-in-Chief, Road Construction Department, Bihar, Patna was directed to consider and dispose off the petitioner's representation dated 27.09.2012, on its own merits and in accordance with law after granting an opportunity of hearing to the petitioner, if the same is still pending.

2. The representation of the petitioner was for revoking the order whereby the petitioner's company had been black listed.

3. Opposite party Nos. 2-4 have filed a show-cause. The Engineer-in-Chief is the opposite party no. 3.

In the show-cause filed by the opposite party nos. 2-4 in paragraph no. 8 thereof it has been stated that in compliance of the order passed by this court, the Engineer-InChief, road construction department, Government of Bihar has passed a reasoned order dated 29.08.2022 vide memo no. 5009(E), whereby the order black listing the petitioner's company vide Departmental order No. 2954 dated 08.05.2015 has been rescinded/cancelled.

5. A copy of the order dated 29.08.2022 has been enclosed as Annexure-A to the show-cause.

6. In view of the above, I find that the order dated 21.12.2018 passed in CWJC No. 14016 of 2015 has been complied with by the respondents.

7. Accordingly, this contempt application stands closed and disposed off.
