The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.
The prosecution case is of assaulting the brother of the informant, Chhathu Sahani, on presumption that he committed theft on the house of the informant, who subsequently succumbed to the injuries.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general and the assault was made by the villagers. The brother of the informant is a habitual thief.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.55289 of 2015 (2) dt.07-12-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Kudhani P.S. Case No.329 of 2015, pending before the learned CJM, Muzaffarpur.
With the above observation, this application is, accordingly, disposed off.
