JUSTICE MADHURESH PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 18-04-2023 The above public interest litigation was suo motu registered by this Court, pursuant to a news report published in Bihari Voice Desk dated 15.06.2021 about an abandoned infant- new born baby.

The affidavit filed in response to the notice issued by this Court, sworn by the Assistant Director, Social Welfare Department, Government of Bihar, indicates that

Patna High Court CWJC No.11554 of 2021(9) dt.18-04-2023 2/3 immediately on information received, a team of Child Line was deputed to the spot from where the infant baby was recovered from the hands of a lady, who found her abandoned. The baby was also admitted to a nearby hospital on 12.6.2021 itself and in accordance with the provisions of Juvenile Justice Act, 2015 was produced before the concerned Child Welfare Committee within 24 hours of rescue. The baby was also directed to be placed in the care of a Child Care Institution/Specialized Adoption Agency. We requested the learned Advocate General to apprise us as to what subsequently transpired; which is stated in an affidavit dated 06.04.2023.

It has been stated by the Assistant Director, Social Welfare Department, Government of Bihar that the Child was given in adoption vide Registration No. BH201745-040 having date of birth 12.06.2021 by the orders of the Additional District Magistrate, Samastipur, bearing Memo No.01/ADO dated 16.03.2023.
