ANJANA MISHRA ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 307/ 406/420 of the Indian Penal Code.

Learned counsel for the petitioner Mr. Asif Kalim submits that the draft which was to have been prepared could not be done and, therefore, the amount which was agreed upon by the parties i.e., rupees two lacs five thousand has been received by the complainant.

Learned counsel appearing for the complainant submits that

Patna High Court Cr.Misc. No.56039 of 2015 (5) dt.18-01-2016 he has received instructions that in fact the said amount has been received by his client.

The complainant is also present in the Court and submits that he has received the same.

Considering the aforementioned facts and circumstances and that the money has already exchanged hands in pursuance of the earlier agreement, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Complaint Case No. 1009(C) of 2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. Learned counsel for the complainant undertakes that the receipt of the agreed amount shall be brought on record in the Court below, let him do so accordingly.
