====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 24-11-2016 Heard Sri Lokesh Kumar Singh, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Bimlesh Kumar Pandey, learned counsel, who has voluntarily appeared on behalf of the complainant/Opp.Party no.2. The petitioner, who is husband of Opp.Party no.2, has prayed for grant of anticipatory bail in Complaint Case No.2734 of 2015, Trial No.4120 of 2016 registered for the offence under Section 498(A) of the Indian Penal Code and Section-4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.48009 of 2016 (2) dt.24-11-2016 2/2 petitioner is ready to settle the dispute with his wife/Opp.Party no.2. This fact has also been stated in paragraph-11 of the petition that the petitioner is still ready to keep the complainant as wife with full honour and dignity.
In view of submission made by learned counsel for the petitioner, the Court proposes to dispose of the present petition with observation that in the event of arrest or surrender within a period of six weeks from today, the petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Gopalganj in connection with Complaint Case No.2734 of 2015, Trial no.4120 of 2016.
It is made clear that the privilege of bail is being extended to the petitioner only on condition that both parties may file a petition before the court below showing settlement of dispute in between the parties. If such petition is not filed within a period of two months from today, the bail bond executed in the present petition in favour of the petitioner shall stand automatically cancelled.
The petition stands disposed of.
