JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Excise Case No. 727 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner was also made accused in Mahsi P.S. case no. 14 of 2018 on the basis of provisions under Excise Act. The petitioner is in custody since 26.03.2019. He further submits that in the instant case total 25.92 litres of liquor was seized. He submits that nothing was seized from the conscious possession of the petitioner.

Considering the fact that the recovery was not made from the conscious possession of the petitioner, the petitioner,

Patna High Court CR. MISC. No.24451 of 2019(2) dt.16-04-2019 2/2 named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum-Special Judge, Excise Act, East Champaran, Motihari in connection with Excise Case No. 727 of 2018.
