JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 14.11.2017 passed in Cr. Misc. No. 45908 of 2017 and also vide order dated 29.08.2018 passed in Cr. Misc. No. 45177 of 2018 and allegation against the petitioner that he committed rape with the daughter of the informant and due to which she committed suicide. Submission of learned counsel for the petitioner is that two witnesses have been examined in the trial and, thereafter, there is no further progress in the trial.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail. However, since the petitioner has been in judicial custody for more than two years,

Patna High Court CR. MISC. No.26984 of 2019(2) dt.01-05-2019 2/2 learned Trial Court is directed to expedite and conclude the trial as soon as possible.

At the same time, Superintendent of Police, Nalanda is directed to ensure the production of witnesses in the trial court so that the trial can be concluded expeditiously. With the aforesaid direction and observation, this application is accordingly dismissed.
