JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-12-2020 Heard the learned counsel appearing for the petitioner and Shri Ashok Kumar, learned A.P.P. for the State. The present petition has been filed for modification of the order dated 04.03.2020 passed in Criminal Misc. No. 8876 of 2020 to the extent that the period granted to the petitioner for surrendering before the learned court below for the purposes of obtaining the privilege of anticipatory bail, be extended by a further period of six weeks from today.

The learned counsel for the petitioner has submitted that on account of the pandemic situation due to COVID-19, the petitioner could not surrender before the learned court below within the stipulated time frame, hence the time granted to surrender, may be extended.

No.26491 of 2020(2) dt.04-12-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time period granted to the petitioner to surrender before the learned court of C.J.M., Motihari, East Champaran in connection with Adapur P.S. Case No. 185 of 2019, for the purposes of availing the privilege of anticipatory bail by a further period of six weeks from today.

Accordingly, the order dated 04.03.2020 passed in Criminal Misc. No. 8876 of 2020 stands modified. The petition stands allowed.
