Learned counsel for the Accountant General submits that on the basis of papers sent from the department, pension and gratuity was authorized and the authority letter has been sent to the Treasury Officer, Patna and a copy also to the petitioner. Learned counsel for the State on the basis of counter affidavit filed submits that the petitioner was absconding from duty since February, 1999 till 30.06.2004 for

Patna High Court CWJC No.9618 of 2007 (7) dt.06-01-2015 2/2 which departmental proceeding is pending and the petitioner is also not cooperating.
