The present application has been filed for modification of order dated 27.01.2012 passed in Cr. Misc. No. 2556 of 2012 to the extent of extending the period of surrender. The petitioner was granted provisional anticipatory bail in a case registered under Sections 498A and 494 of the Indian Penal Code for one year on readiness of the petitioner that petitioner being the husband of the informant is ready to keep the informant as wife with full dignity and honour and has not performed second marriage.
It is submitted by learned counsel for the petitioner that the petitioner could not furnish the bail bonds
Patna High Court Cr.Misc. No.26565 of 2016 (2) dt.17-08-2016 2/2 since he was not getting the bailor.
Since the provisional bail was granted for one year vide order dated 27.01.2012 which has already expired on 26.01.2013 and the present modification application has been filed on 27.06.2016, this Court is not inclined to entertain the prayer for modification of the initial order dated 27.01.2012. Since the petitioner is still ready to keep the informant as wife with full dignity and honour, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Barahiya P.S. Case No. 58 of 2010 pending in the court of learned Chief Judicial Magistrate, Lakhisarai. Accordingly, this application is disposed of with the above observation/direction.
