The petitioner apprehends his arrest in Phulparas P.S. case No. 45 of 2017 for the offences punishable under Section 324, 379 and other Sections of the Indian Penal Code. The informant alleged that some quarrel took place due to plucking of mango leaves. The petitioner is alleged to have assaulted the informant with axe on her head. The learned counsel for the petitioner submits that petitioner is co-sharer and neighbour of the informant. The injury is simple in nature.

It appears that there is no repetition of blow. The nature of injury is simple and superficial as the doctor found one lacerated wound 1⁄4 x1/8 cm. on the scalp of informant.

No.43828 of 2017 (2) dt.03-10-2017 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani in connection with Phulparas P.S. case No. 45 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
