====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 21-05-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioners apprehend their arrest in connection with Hajipur Sadar P.S. Case No.735 of 2024 instituted under Section 126(2), 127(2), 115(2), 118(1), 74, 109, 351(2), 352, 3(5) of the B.N.S., 2023.
3. As per the prosecution case, on the date of occurrence the informant was in her house then accused persons including the petitioners came with sword and khanti at her door
Patna High Court CR. MISC. No.27776 of 2025(2) dt.21-05-2025 2/3 and started abusing which was protested by the informant. It is alleged that co-accused Amrita Kumari and Kavita Kumari threatened her at door by holding her hair and co-accused Lali Rai hit by sword. Co-accused Ratnesh Rai caused injury in the stomach of the husband of the informant and co-accused Amit Kumar assaulted with sword. The children of the informant was also assaulted.
4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. He further submits that there is land dispute between the parties and a free fight happened between them, in which both the parties got injuries. Learned counsel submits that the injuries on the injured are simple in nature. He further submits that both the parties are pattedar and close neighbor and there is case and counter case between the parties. He also submits that petitioners have no criminal antecedent and they undertake to cooperate in the investigation.
5. Learned A.P.P. for the State and learned counsel for the informant opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks
Patna High Court CR. MISC. No.27776 of 2025(2) dt.21-05-2025 3/3 from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No.735 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
