JUSTICE ANIL KUMAR SINHA ORAL ORDER 14-09-2020 Heard Mr. Uday Kumar , learned counsel for the petitioner and Mr. Umeshanand Pandit, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Sonbarsa P.S. Case No. 63 of 2020 registered for the offence punishable under Section 399 , 402 , 414 of the I.P.C. and Section 25 (1-B) a, 26 and 35 of the Arms Act. The allegation against the petitioner as per the First Information Report is that Police on the basis of confidential information regarding preparation for commission of crime by some miscreants proceeded towards the place of occurrence and upon seeing the Police party, the accused persons tried to flee away, but out of them, petitioner along with other accused persons were apprehended and upon search two live cartridges have been recovered from the pocket of the petitioner. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.23613 of 2020(2) dt.14-09-2020 2/2 petitioner has falsely been implicated in this case. Learned counsel further submits that petitioner has got no criminal antecedent and he is in custody since 16.03.2020 i.e. for about six months.

Having regard to the submissions made by the parties , taking into consideration the fact that petitioner has got no criminal antecedent and he is in custody since 16.03.2020 , I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, District - Sitamarhi / court concerned in connection with Sonbarsa P.S. Case No. 63 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
