====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-08-2021 Heard the parties through video conferencing. As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office vide its notes dated 22.06.2021, within four weeks of starting of Court proceeding in physical mode in normal course. The present application has been filed for modification of order dated 02.09.2019 passed in Criminal Miscellaneous No. 55523 of 2019, whereunder, both petitioners were allowed privilege of pre-arrest bail, but, inadvertently, in para-03 of the petition, it was detailed that petitioners have no criminal antecedent, while the petitioners are accused in Silao

Patna High Court CR. MISC. No.36393 of 2021(2) dt.18-08-2021 2/2 P.S. Case No. 114 of 2019, as detailed in para-03 of the modification application.

During the course of argument, Sri Rama Kant Sharma, learned Senior Counsel appearing on behalf of petitioners prayed to withdraw this application with liberty to the petitioner to surrender before the learned trial Court and seek regular bail.

In view of the above submission, the application filed on behalf of petitioners is dismissed as withdrawn with liberty to the petitioners to surrender before the trial Court and seek regular bail.
