JUSTICE ARUN KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. Petitioners apprehend their arrest in connection with a case registered under Sections 341, 323, 324 and 307/34 of the Indian Penal Code.
Allegation in brief is that accused persons due to land dispute assaulted the informant and he was also assaulted by Md. Hasimuddin by knife causing injury in the side of the chest and Md. Shamsher also sustained injury on the left elbow. Learned counsel for the petitioners submits that there is land dispute between both sides and there is case and counter case also and the informant's side was aggressor, one of the injured from the petitioners' side got fractured injury. The
Patna High Court Cr.Misc. No.37673 of 2017 (2) dt.10-08-2017 2/2 petitioners have no criminal antecedent.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Md. Afroz, Md. Firoz and Md. Hasmuddin @ Asim be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Kasba P.S. Case No.57 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
