JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioners apprehend their arrest in connection with Narpatganj P.S.Case No. 354 of 2017 registered for the offences under Sections 366A, 341, 323, 504 and 506/34 of the Indian Penal Code.

Petitioners are not named in the FIR and allegation them is of kidnapping minor girl of the informant. Submission of learned counsel for the petitioners is that the girl has been recovered and she has not named these petitioners, rather she has named one Ravi @ Indrasand Kumar Paswan and petitioners happen to be father and brother of Indrasand Kumar Paswan.

In the facts and circumstances, let the petitioners, above

Patna High Court Cr.Misc. No.4088 of 2018 (2) dt.01-02-2018 2/2 named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S. Case No. 354 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
