This application for grant of anticipatory bail arises out of Narpatganj P.S. Case No. 194 of 2016, disclosing offence under Sections 272 and 273 of the Indian Penal Code and 47(a) of the Excise Act.
From the possession of the petitioner, country made liquor was allegedly recovered by the police personnel. It is alleged that the petitioner managed to flee away on seeing the Police.
Considering the gravity of the offence and serious consequences of consumption of illicit country made liquour, I am not inclined to grant the privilege of anticipatory bail to the
Patna High Court Cr.Misc. No.42446 of 2016 (2) dt.17-10-2016 2/2 petitioner.
Accordingly, this application for anticipatory bail is, hereby, rejected.
The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
