JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Khaira P.S. Case No. 267 of 2015 registered under Sections 448, 324 and 307/34 of the Indian Penal Code.

The accusation is that in the night of 21/22.12.2015, the informant, Narayan Ravidas, was sleeping in his house. At that time, petitioner and Tullo Ravidas having knife in their hand entered in the house and this petitioner with intention to kill him attacked through knife causing injury at his three fingers of left hand whereas Tullo Ravidas also caused injury through iron rod. When wife of the informant rushed to save him then Prakash Rvidas and Dobi Ravidas with intention to kill her caused injury at

Learned counsel for the petitioner submits that there is specific allegation against the petitioner to caused injury at the fingers of the left hand of the informant, but the injuries were found simple in nature. Moreover, after investigation police submitted that the final form against the petitioner and two others only submitting charge sheet against co-accused, Dhobi Ravidas, but later on, the cognizance against the petitioner has also been taken on protest.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No. 267 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
