The petitioner is apprehending his arrest in connection with Naugachhia P.S.Case No. 87 of 2015 registered for the offences punishable under Sections 365, 323, 379, 504 and 506/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the allegation against petitioner is of forcibly marrying his son with the daughter of the informant and during the course of investigation it has come in paragraph-44 of the case diary that the case has wrongly been filed and in some other paragraphs it has come that the marriage was solemnized but the parties are not agreeable to that. It has further been submitted that, as a matter of fact, marriage was neither solemnized nor any demand was made
Patna High Court Cr.Misc. No.51934 of 2016 (3) dt.30-01-2017 2/2 and a completely false case has been filed against the petitioner. Heard learned APP also.
Having heard both sides and in view of the facts stated above, let the petitioner, Sanjeev Kumar Rai, in the event of his arrest or surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st , Naugachhia, in connection with Naugachhia P.S.Case No. 87 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall co-operate in the investigation and make himself available before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, except showing some genuine ground, his bail bond shall be liable to be cancelled.
