This is repeat application seeking anticipatory bail on behalf of the petitioners who had earlier preferred an application for grant of anticipatory bail which was disposed of on 01.09.2016 (Annexure-1) observing that the petitioners have failed to demonstrate reasonable apprehension of being arrested. Referring to Annexure-5, which is an order passed on 02.09.2016 in Cr. Misc. no. 32881 of 2016, it is submitted that two other accused persons who carry serious allegation in the First Information Report ( for short 'FIR') have been granted the
Patna High Court Cr.Misc. No.55469 of 2016 (2) dt.15-02-2017 privilege of anticipatory bail. However, he is unable to show that in case of issuance of summons only the petitioners have reasonable apprehension. If there is any apprehension, the petitioners shall be at liberty to apprise the Court of the order dated 02.09.2016 passed in Cr. Misc. No.32881 of 2016 at the time of appearing before the learned Court below pursuant to the summons issued to them.
The present application is disposed of.
